This appeal arises out of a wrongful death action brought by appellant pursuant to Ind. Ann. Stat. § 2-404 (1967 Repl.) in the Marion County Probate Court. Appellant, as the administratrix of the estate of Robert Lowell Pickens, deceased, brought suit for damages resulting from the wrongful death of the intestate which damages were to inure to the exclusive benefit of the deceaseds two dependent minor sons, Robert Rex and Michael Duane Pickens. The decedents death was caused by a fatal gunshot wound inflicted by his second wife, Helen Foster Pickens, hereinafter referred to as appellee, who later plead guilty and was convicted of the crime of involuntary manslaughter.
